A federal tax refund is not sent to anyone. It is routed. Four subsections of the Internal Revenue Code each carry a paragraph captioned Priorities for offset, and together they set out a queue the refund stands at the back of. A refund can be taken at one hundred percent where a federal salary is capped at fifteen. The notice comes from a bureau that is not the IRS, and the dispute goes to neither of them. And a bank account can sit between the Treasury and the taxpayer before any of it arrives.

The argument

A refund is not sent to you. It is routed, and there is a queue.

Start with the order, because almost nobody knows there is one. Four separate subsections of section 6402 each contain a paragraph captioned Priorities for offset, and read together they produce a sequence: your own federal tax liability first, then past-due child support, then federal agency non-tax debt, then state income tax and unemployment compensation debt, and only then a credit toward your own next year. The subsection lettered second is paid last. Where there is more than one debt inside a category the statute does not leave that to discretion either, directing that the overpayment be applied against those debts in the order in which they accrued, a sentence that appears three separate times.1 Set the share that can be taken beside the other payment types the same program reaches and one stands out: a federal salary is capped at fifteen percent of disposable pay and Social Security at fifteen, while a tax refund can be taken at one hundred percent.2 Three thresholds decide whether a debt ever enters the queue, at twenty-five dollars, a hundred and twenty days of delinquency and sixty days of notice, and a fee is deducted from the money before the creditor agency is paid, which the regulation permits the agency to add back onto the debt.3 The program's own collection figure is three point eight billion dollars, and the fiscal year attached to it closed two years ago with nothing published since.4 And if the refund does arrive, whether it earns interest turns on a window measured from the unextended due date rather than the day you filed, with a second rule deeming tax withheld from a January paycheck to have been paid in April.5

Then the part where something has gone wrong, which is where the separations show. The review subsection closes three doors in three sentences and opens a fourth in the last one, and that last sentence is the one summaries drop: no court may restrain or review the reduction, no administrative review lies with the Secretary, no action against the United States counts as a refund suit, and none of that precludes action against the agency or state that received the money.6 The letter telling a taxpayer what happened is required by statute from Treasury's disbursing official and sent by the Bureau of the Fiscal Service, not by the IRS, whose own page says the details of the offset are not provided to it; the offset program's own questions and answers say its staff cannot discuss the debt, refund anything or discuss payment options.7 For a spouse whose share of a joint refund was taken for the other spouse's separate debt there is a route, and it has three published processing times rather than one, at roughly fourteen weeks, eleven weeks or eight depending on how it was filed.8 It is not the same instrument as innocent spouse relief and the agency says so in one blunt sentence inside the form's own instructions.9 And when the repair happens, the money comes back along a different road from the one it left by: the IRS pays the spouse their share and then asks the Fiscal Service to deduct that amount from what is payable to the creditor agency.10

Then the last hundred feet, which is where ordinary filers get caught. No more than three refunds may be deposited into a single financial account or prepaid card in a year, a limit effective since January 2015 that is an administrative procedure and not a Code section, and one that counts deposits into an account rather than returns filed by a person.11 The account must bear the taxpayer's own name, and the two instruments enforcing that do not reach the same people: the practice regulation binds only practitioners while the Code provision reaches any tax return preparer.12 A refund can be split across two or three accounts, and the form that does it can no longer do the thing named in its own title, because the savings bond option was discontinued and the Reminders section says so while the title still advertises it.13 What happens to a fourth refund in one year we are not going to tell you, because two of the agency's own pages, both reviewed within the last fortnight, answer it differently and card 14 prints both.14 And a deposit that lands in the wrong account has had a written answer since December 2020: report it, the agency traces it, and a replacement issues in the full amount.15

Last, who handles it. The practice rules still contain an entire category of registered preparer with testing and education attached, a federal appeals court held in 2014 that the agency had no power to create it, and the government's own proposed rule of December 2024 concedes the provisions are no longer enforceable; the removal is still only a proposal and the text current to October 1, 2026 carries forty-nine references to the struck category.16 What is actually required of a paid preparer who is not an attorney, a certified public accountant or an enrolled agent is a number, a fee and an annual renewal, with no exam and no education, and the program that looks like a credential answers the question of whether it is mandatory with the word voluntary.17 There are 886,338 people holding that number as of the first of September, and this page will not subtract the credential counts from it because the agency's own caveat says the categories overlap.18 And the last party in the chain is a bank: a temporary account receives the refund, deducts the preparation fee and its own, and forwards what is left.19 Fifteen further claims this page refused are published together so they can be checked.20
